DoH Update on Foodstuff, Cosmetics and Disinfectants – June 2019

Since Act 54 is relevant to the cosmetic industry, the notice below affects the industry. The sections of the Act that are referenced in the notice are as follows:

  • Section 10: Inspectors
  • Section 11: Powers, duties, and functions of Inspectors
  • Section 24: Right to prosecute

On 10 June 2019, the Minister of Health published: Gazette No 42521, Notice No. R 896 – FOODSTUFFS, COSMETICS AND DISINFECTANTS ACT, 1972 (ACT 54 OF 1972) ENFORCEMENT BY LOCAL AUTHORITY.

The Minister authorized the following municipalities to enforce sections 10(3)(b), 11, and 24 of the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act 54 of 1972), within their area of jurisdiction and through duly authorized officers:

  • Nkangala District Municipality
  • Lejweleputswa District Municipality
  • King Cetshwayo District Municipality

The notice also includes the withdrawal of authorization of certain local authorities.
